These terms and conditions apply to orders which you place using this website, operated by Deborah Broughton Original Art. Please read them carefully before placing your order. By purchasing from my site you accept these Terms and Conditions. Nothing in these Terms and Conditions affects your statutory rights, either as a consumer or otherwise.
Usage Rights
I reserve the right to refuse access to the Shop, terminate accounts, remove or edit content, or cancel orders at my discretion. If I cancel an order, it will be without charge to you.
Colours, specifications and dimensions of products
I have made every effort to display the colours, specifications and dimensions of items accurately as possible. The colours you see will depend on the resolution of your monitor, I cannot guarantee that your monitor's display will reflect accurately the colour of the item. I may at times change the dimensions, specifications and quantities of items displayed on our Website.
Use of site by Minors
This site does not contain any products or images that may be offensive or inappropriate to minors. If you are under 18, you may use this Website only with the involvement of a parent or guardian.
Availability of Items and Substitution
I accept orders subject to availability. If for any reason the items you ordered are no longer available, I will offer an alternative item where possible; or cancel the item and give you a full refund for that item.
Your Profile
You are responsible for all activities that occur under your account. Please keep your login details confidential and inform me immediately if your username and/or password is being used in an unauthorised manner.
Please ensure the details you provide on registration are correct and updated. You can access and update your registration details using the "My Account" area of the Website.

Pricing
Products are invoiced in Australian Dollars. Although I try to ensure that all prices are accurate, errors may occur. If I discover an error in the price of items you have ordered, you will have the option of either reconfirming your order at the correct price or cancelling it.
Prices displayed on the Website apply to online purchases only. They are not indicative of the price of identical items purchased by any other means.
Payment
You may pay for the items which you order online by supplying your Credit Card details on the secure online order form. I also accept PayPal, Cheques, Money Orders and Direct Deposit. All payments will be subject to clearance before an order is dispatched. Please do not send Credit Card information using email or cash via mail.
Return Policy
All goods are shipped with a 100% satisfaction guarantee, or your money back. However, some conditions do apply, so please take note of these:
1) If your item arrives damaged or faulty, or if we have sent you an incorrect item, please notify us as soon as possible, We will send you the replacement item as soon as possible.
2) I do not refund for "change of mind" reasons but will exchange for another of a similar value.
3) Guarantees are extended to the Original Purchaser only, and do not extend to any third party recipient of the items.
Costs
I will reimburse any reasonable costs you incur in returning the items to us where they were delivered to you in error, damaged upon delivery or are defective or incorrect. You will be responsible for the costs of returning items to us in all other circumstance. You are responsible for the safe keeping and safe packaging and transit of returned items. I do not accept liability for returned packages damaged during transit back to me.
Liability
I will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill). Our liability to you will not exceed the total price charged for the item/s purchased.
Events beyond our reasonable control
I will not be responsible to you for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.
Alterations to this Website and Terms and Conditions
I reserve the right at any time to make changes to this Website, these Terms and Conditions, Privacy Statement and such other policies as we may notify you of. If any of the terms and conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, it will be deemed severable and not affect the validity and enforceability of the remaining terms and conditions.
Waiver
If you breach these Terms and Conditions and I take no action we will still be entitled to use our rights and remedies in other situations where you are in breach.
Governing law and jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of Australia. You agree to submit to the non-exclusive jurisdiction of the Australian courts, as do we.
